Terms of Service

1. Accepting these Terms

These Terms of Service govern your use of the Langualy app and the langualy.app website. By creating an account and using Langualy, you agree to them. If you do not agree, do not create an account and do not use the service.

The Privacy Policy is part of these Terms and explains how we handle the information of the people who use the app. Both are worth reading.

2. Who provides Langualy

Langualy is operated by Viper LTDA, registered under Brazilian company number (CNPJ) 51.663.220/0001-36, trading as Viper, with its registered office at Rua Manoel Medeiros Guedes, nº 12, Sala 201, Manaíra, João Pessoa – PB, postcode 58038-360, Brazil.

We operate at langualy.app and langualy.com. To reach us about anything covered by these Terms: help@langualy.app.

3. Who can use it: 18 and over

Langualy is intended for people aged 18 or over. By creating an account, you declare that you are at least 18 years old.

We do not ask for your date of birth and we do not store your age: we only record the date and time when you made that declaration, together with your acceptance of these Terms and of the Privacy Policy.

The minimum age exists because the learning content may include slang, vulgar terms or offensive expressions when they are relevant to learning. Those items carry the corresponding editorial label inside the app.

If we identify that an account belongs to someone under 18, we may suspend and delete it, along with the associated data, subject to applicable legal obligations.

4. Your account

Using Langualy requires an account with a display name, an email address and a password. There is no social sign-in. The account is what keeps your progress and holds it in sync.

By keeping an account, you undertake to:

• provide a valid email address that you control;
• choose your own password and keep it secret;
• not share your credentials or let anyone else use your account;
• tell us at help@langualy.app if you suspect unauthorised access.

You are responsible for the activity carried out through your account. If you forget your password, use the recovery option on the sign-in screen: we send a link to your registered email address.

Having more than one account is not prohibited in itself. What is prohibited is using additional accounts for fraud, for abuse of the infrastructure, or to circumvent limits, restrictions or suspensions.

5. What Langualy does

Langualy is a vocabulary acquisition app. Its content is organised around the most frequently used words and expressions of the language, and each word is worked through four skills:

• Reading: you read the official sentence, try to understand it, and then see the translation, the pronunciation and the meaning. You rate yourself.
• Speaking, through shadowing: you listen to the official audio, record your voice, and the app compares what was recognised against the expected sentence.
• Listening, through dictation: you type what you heard, and the app compares your answer with the official sentence word by word, on your own device.
• Writing: you produce an English sentence using the requested word and write, in Portuguese, what you meant. An artificial intelligence service analyses both.

A spaced repetition algorithm works out when each skill of each word should come back. The app also shows your progress, an adjustable daily goal, your streak of study days, and the number of consolidated words — My Vocabulary.

At launch, the available study language is American English and the interface is in Brazilian Portuguese.

6. Educational in nature: what we do not promise

Langualy is a study aid. It helps, but it works no miracles, and that is worth stating plainly:

• we do not guarantee fluency, exam success, a specific level, or any particular outcome;
• results vary with each person’s dedication, frequency and starting point;
• the app does not replace a teacher, a professional translator, a school, a full course or an official proficiency certification;
• Langualy specialises in vocabulary and does not aim to be a complete language course.

Nothing in this section removes rights that the law grants you, in particular under the Brazilian Consumer Protection Code.

7. Automated correction and artificial intelligence

Some of Langualy’s corrections are automated. They work like this:

Automated corrections get things wrong. Transcription may hear one word for another; artificial intelligence may misread your intention; the dictation comparison may treat an answer you consider valid as different. Treat the result as study support, never as an official assessment of proficiency.

When a correction looks wrong, you can dispute it from within the exercise. A dispute does not change the rating already recorded, but our team reviews the case and it may lead to content fixes in later versions. The Privacy Policy describes exactly what is sent in each type of dispute.

Langualy does not use the texts you write or your recordings to train models of its own.

8. The content you create

The sentences you write, the meanings you state in Portuguese, your dictation answers and your voice recordings are yours. We acquire no ownership over that content, and you remain free to use it however you like.

So that the exercise can work, you grant us a free, non-exclusive and limited licence to process that content only as far as necessary to:

• run the exercise you started;
• transcribe the recording and correct or assess the answer, including through the providers named in the Privacy Policy;
• show you the result;
• review a dispute you have submitted;
• protect the service against fraud and abuse;
• comply with legal obligations and exercise or defend rights.

The licence ends with the purpose. It is not perpetual, not unrestricted, does not authorise publication, does not authorise advertising use, and does not authorise training any Langualy model.

You are responsible for what you write and record. Do not enter sensitive data, third-party information, passwords or unlawful content in the exercise fields — they exist for practising the language.

9. Langualy content and intellectual property

Viper LTDA owns, or is authorised to exploit commercially, everything that makes up Langualy, including:

• the bank of words and expressions and the order in which they appear;
• the sentences, translations, pronunciations and classifications;
• the word and sentence audio;
• the explanations, the texts and the pedagogical organisation;
• the illustrations, the icons and the visual identity;
• the Langualy trademark, the logo and the associated names;
• the software, the interface, the code, and the content databases and compilations.

The selection, organisation and curation of that material are protected in their own right, even where individual elements are in common use.

10. What you may and may not do with the content

We grant you a personal, non-transferable, revocable and non-exclusive licence to use Langualy to study. Ordinary use includes the following, and we see no problem with any of it:

• taking screenshots and sharing them;
• writing words and sentences down in your notebook or your own flashcards;
• commenting on the app and showing parts of it to other people.

What is not permitted, to the extent the law allows us to restrict it:

• extracting the content in bulk, by any means, manual or automated;
• scraping or systematically copying the catalogue;
• redistributing, reselling, licensing or publishing the content;
• building a competing database, course, app or product from our material;
• using the audio, the translations or the sentences in another product;
• automating access to the service without written authorisation;
• reverse engineering, decompiling or disassembling the software, outside the cases expressly permitted by law;
• circumventing usage limits, technical protections or access restrictions.

11. Prohibited conduct

In addition to the previous section, Langualy may not be used to:

• commit fraud of any kind;
• abuse the infrastructure, including abnormal request volumes;
• create multiple accounts to circumvent limits, restrictions or suspensions;
• share access in order to get around usage limits;
• interfere with the operation of the service or degrade it for other people;
• exploit vulnerabilities, attempt unauthorised access or distribute malicious code;
• infringe third-party rights, including intellectual property and privacy;
• carry out any unlawful act or any act contrary to these Terms.

12. Suspension and termination

We may suspend or terminate access for accounts used for the conduct described above, or where necessary to comply with the law, protect other people or preserve the security of the service.

Whenever reasonable, we will state the reason and you may challenge the decision at help@langualy.app. Where immediate action is required — security, fraud, protection of third parties, or compliance with a legal order — the measure may be applied before notice, and the right to challenge it remains available afterwards.

You may stop using the service at any time by signing out or deleting your account.

13. Deleting and recovering your account

Account deletion is done inside the app, under Profile and settings. For safety, we ask you to type a confirmation word and your current password.

After that:

1. the account enters a 30-day recovery period, and the deadline is shown on that screen;
2. during that period you can still sign in with your email and password, but the app opens straight into a recovery screen instead of the study flow;
3. confirming recovery on that screen cancels the deletion and restores the account with all your progress;
4. after 30 days, an automated routine deletes the account permanently;
5. from then on the account cannot be recovered, not even by us.

After permanent deletion, only records strictly necessary to comply with legal obligations, for security and fraud prevention, or to exercise and defend rights may remain. Those records do not constitute an account and are not available for ordinary use of the service. The Privacy Policy describes exactly what is deleted and what remains.

14. Resetting your progress

Without deleting your account, you can reset your progress in a language. There are two options, and both are final: there is no undo.

Disputes you have already submitted are not affected by a progress reset.

15. Availability and changes to the service

Langualy depends on an internet connection and on third-party services — hosting, transcription, automated correction and the app store. Failures in those services may leave the app unavailable or with limited features.

We will make reasonable efforts to keep the service running and working well, but we do not guarantee uninterrupted or error-free operation.

The product is under continuous development. Content and features may be fixed, changed, replaced or removed over time. Where a change is significant and advance notice is reasonably possible, we will announce it in the app, on the website or by email. We do not undertake to give advance notice of every single change.

16. Free at launch

At this launch, Langualy is entirely free. There is no subscription, no premium plan, no in-app purchase, no paid trial, no advertising and no reward for viewing ads.

If we ever offer paid features, the conditions will be presented beforehand in specific terms, and nothing will be charged without your subscribing to it. These Terms do not authorise any future charge.

17. Third-party services

To function, Langualy relies on services operated by other companies: hosting and database, speech transcription, automated correction by artificial intelligence, and the app store that distributes the program. Those providers are named in the Privacy Policy.

Each of those services has its own terms and policies, and their relationship with you, where one exists, is governed by those documents. We choose and oversee our providers, but we do not control their internal operations.

18. Limitation of liability

We are liable for damage we cause, in accordance with applicable law. To the extent the law permits, we are not liable for:

• unavailability caused by connection failures, device failures or third-party services;
• decisions you make based solely on an automated correction;
• learning outcomes, which depend on how each person uses the app;
• use of your account by a third party as a result of password sharing;
• loss of temporary content that, by design, is not stored — recordings and exercise texts.

No part of these Terms excludes or reduces non-waivable rights granted by Brazilian law, in particular those in the Consumer Protection Code. A clause found to be invalid is set aside only to the extent of its invalidity, and the remainder stays in force.

19. Misuse on your part

If your use of Langualy in breach of these Terms or of the law causes proven damage to us or to third parties, you are liable for that damage within the limits and conditions set by applicable law. This clause creates no obligation beyond what the law already establishes.

20. Privacy

The processing of personal data is described in the Langualy Privacy Policy, which forms part of these Terms and is published on the same website, and is also accessible inside the app.

21. Changes to these Terms

We may change these Terms to reflect changes in the service, in the law or in our practices. The effective date and the version number always appear at the beginning and at the end of the document.

Where a change is significant, we will announce it in the app, on the website or by email. Where the law or the nature of the change requires it, we will ask for your agreement again before applying it to you.

22. Governing law and jurisdiction

These Terms are governed by Brazilian law, including the General Data Protection Law (Law No. 13,709/2018), the Internet Civil Framework (Law No. 12,965/2014) and the Consumer Protection Code (Law No. 8,078/1990), where applicable.

The courts of João Pessoa – PB, Brazil, are chosen to settle disputes arising from these Terms. This choice does not remove a consumer’s right to bring proceedings in the courts of their own domicile, nor any other forum that the law mandatorily guarantees.

We do not impose mandatory arbitration.

23. Languages of this document

We publish these Terms in Brazilian Portuguese, English and Spanish. All three versions aim to communicate exactly the same rules.

In the event of a difference in interpretation between them, the Brazilian Portuguese version prevails, to the extent permitted by applicable law. This rule does not remove rights mandatorily guaranteed by the user’s own jurisdiction.
